As Simmons Calls for Concession, Deely Starts Recount Fund Campaign
In an open letter to supporters, 131st District challenger Kevin Deely looks to raise funds for a recount while incumbent state Rep. Justin Simmons calls for him to concede.
With the election less than 48 hours behind them and the race still up in the air, Kevin Deely is asking supporters for help in a possible recount of the 131st state House race.
Deely, the Democratic candidate, took to social media to ask for help in covering the cost of a ballot recount.
The letter, posted on his Facebook page, reads:
Dear supporters,
I appreciate your patience in waiting for the election results to be posted. Things are changing rapidly and it may take a week or two until we know the final results. Thank you for your support - I am humbled and honored by the support from every person who cast their vote, and I will fight to make sure than each of these votes is counted.
A recount will be expensive. It costs $50 per voting machine - $6100 in Lehigh County, and more in legal fees. If you'd like to make a contribution in this endeavor to protect the democratic election process, we would greatly appreciate it. Visit www.kevindeelypa.com and click on the donate page.
The race could be weeks from certification, said Lehigh County's Director of Elections Timothy Benyo. With all polls reporting, Simmons was leading Deely by 562 votes, according to unofficial tallies. According to reports, the margin could be as close as 167 votes with Simmons ahead.
In district races, a recount is only triggered if three or more voters come forward to challenge results. According to the Lehigh County election office, it would cost approximately $6,100 to recount each machine in the county's part of the district.
Simmons, who thanked voters at Oliver Shakewell's Tuesday evening, called for Deely to concede the race. In a statement to Patch, Simmons writes:
After an extensive study of the vote in the 131st district, it is clear that there is no path to victory for Kevin Deely. Even if every outstanding absentee and provisional ballot went his way he could still not make up the difference. It is time for Kevin to put the people of our district first and concede so we can move forward.

That's rich. I think the democratic process ensures that every vote is counted. Concede? You've got to be kidding. Corbett's soldier can march himself into the side of a building. He needs to go and so does his boss. Maybe Simmons ought to be a good citizen and make sure everyone's vote is counted.

No one likes a sore loser Mr. Deely. I say, put up or shut up. If you want the recount, then man up and pay the $6,100 to cover the costs yourself. You should have planned ahead for this contingency and it speaks volumes to voters that you did not. In these hard economic times, you clearly have no mandate from your Democratic constituency. Yes, I voted for Mr. Simmons and I doubt very much if he were in your position he'd be asking voters to pony up more money for a recount. I've met him and I've met you. Big Bird says the word of the day is "integrity".

If Mr. Simmons has thoroughly studied the district and arrived at the conclusion that Deely cannot win than why ask for a concession? Respectfully allow the votes to be counted and respect democracy. It's not like the legislature is going to be in session tomorrow. We don't have hanging chads like Florida 2000.

The arguments coming from the Simmons camp and his followers are just ridiculous. Why not count EVERY vote? Is that not the way of our democracy, even when it's not politically convenient? The people who took the time to fill out absentee ballots deserve their votes to be counted. I don't care if you're a democrat or republican or which candidate you support, we need to value and protect the integrity of our state's democratic process.

I do not believe Representative Simmons is saying do not count the votes. I believe he is saying why waste time and money on a RECOUNT. In 2000 the vote difference in Florida was 537 votes out of 5,963,110 votes cast. Recounting the entire state of Florida they could not find enough votes to change the result. in the 131st District with approximately 28,000 votes cast and a vote differential of 532 votes you are not going to find 533 hidden/uncounted votes for Deely. Mr. Deely is just being a poor loser. He rode the Obama wave of straight party democrat voters in the city of Allentown and got crushed losing by around 20% in the suburbs. This race is over if deely wants to waste his supporters money they should at least know the facts.

When a someone goes on vacation (in this case especially when the house is not even in session) is none of your business. Plus when Simmons goes on vacation we do not have to pay for a substitute to do his job. Unlike Mr. Deely (and the other teachers who were forced by the teacher union to take off and work the polls for him) who abandoned his students so that he could go politic.

I , along with many of my family & friends have honestly found Rep.Simmons to be helpful, honest, and very concerned about his constituents.We voted- Rep.Simmons won. Game over. It's unfortunate that Mr.Deely is having such difficulty understand this process. Perhaps he needs to lay off the "smokes" so he can focus better & completely understand so he doesn't destroy his chances if he ever runs again. :)

There's a lot of bantering and ugliness going on here. I'm not quite understanding the issue. Are there votes that have not been counted? If that's the case, count them. Spending money to REcount ballots that were already counted, is another story. If that's the case, my question is "why?". Seems fairly straight forward.

According to Lehigh County Election office there are 133 provisional ballots (aka people who did not appear on voter rolls) 60 military ballots first time voters who voted absentee and have not proven their ID. (ie social security number or valid ID not part of the voter ID law has been around for years) and 6 emergency worker absentee ballots (ie police or fireman who were on duty) Grand total of 204 ballots outstanding. At this point ALL votes will have been counted. IF Deely gets all those votes which is unlikely he is still down losing by 251 votes.

Also for a statement to be considered defamation it must also be untrue.
While Deely has never formally been charged with possession of Marijuana there is public knowledge of a situation connecting Mr. Deely to a case involving Marijuana would likely create a strong enough connection that it would be impossible to say such a statement is defamation.
There is also a different standard when it comes to people seeking elected office. Which is why your statement about Mr. Simmons would also likely not considered defamation, unless Mr. Simmons could prove that the defamatory statements were made with knowledge that they were false or with reckless disregard of whether they were false. (Kinda like how Mr. Deely said that Simmons will destroy Social Security and Medicare even though he couldn't as a state Rep, but who knows maybe Deely legitimately didn't know that)

If anyone's goal is to serve big oil and gas it was the Democrats from the last administration. The Republicans got results where the Democrats sat on their hands for years. Republicans increased environmental standards to some of the strictest in the nation, imposed an impact fee, and increased setbacks. You talk a lot about Republicans hating the environment, but I didn't see Democrats do any of that while they had their shot. They talk a big game but get nothing done, even if what the R's did with Marcellus Shale isn't perfect it is more then Fast Eddie and the Democrats were able to do.

Can we just end this? This is an election for State Rep not the Presidency. We don't need to go any farther. It is clear and evident that State Rep Simmons has won this race and won it by the true electorate that he represents. The majority of the votes that Mr. Deely received were from direct Democrat Party Ticket casting. No one truely voted for this man in this district they were voting for Mr. Obama for the Presidency.If anything we need to really question the intentions of the Democratic Party of Lehigh and Northampton County. Clearly they tried to insert a man with no political skill and no knowledge of politics to run for office. They wanted this win because this win would cause Deely a hardcore Democrat and Bobble Head for his true Supporters (a.k.a. the Unions) into a State Rep seat that will lose the majority of its registried Democratic voters during the next election season do to redistricting. If your favorite NFL team lost on a disputable call at the end of the game, wouldn't you want the replay looked at? Well since no state money is being spent here thats what is going on here. If Mr. Simmons has the most votes in the recount, he'll still win. If Mr. Deely does then the recount was genuinely needed. Why is that so troubling?

It is not troubling, it is annoying and unnecessary. There are not enough uncounted votes to make Deely win, even if 100% of them went to Deely. In the 2000 election they couldn't find 500 votes in the entire state of Florida that were changed to make Mr. Gore win, and honestly if they do recount I think Simmons will end up winning by even more. If Deely wants to continue to waste time and money that is on him, but the rest of us are ready to move on.

Election night left state Rep. Justin Simmons looking like a winner but county officials today say the outcome of the 131st House race is not yet certain.
Hundreds of ballots are still to be counted. It's expected to take weeks to finalize the outcome.
"I'd say there are between 750 and 1,000 ballots left to count," said Lehigh County election official Tim Benyo.
A preliminary tally without those ballots shows Simmons with a 562-vote lead. So I don't know where people are getting the number of 200 outstanding

The 750 to 1000 number was across the entirety of Lehigh County, not the 131st District.
I know Deely's camp has trouble identifying where the 131 actually is, being that Kevin had it wrong on his website until Simmons pointed it out to him during the first debate.
FYI the 131 is not the entirety of Lehigh County, only part of it, that is where the 200 number comes from, right from the County.

Right now, Lehigh County has Simmons lead at ONE VOTE. Makes me wonder why anyone would want to rush this. It's going to take some time to get the official number, between provisional and absentee ballots.
